Whether or not Mayor Jejomar Erwin “Junjun” Binay Jr. and the rest of the resource persons asked to attend the Blue ribbon subcommittee inquiry into the allegedly overpriced Makati parking building will appear on the next scheduled hearing is a test to the resolve of Senators Aquilino Pimentel III, Alan Peter Cayetano and Antonio Trillanes to have them arrested if they will ignore the summons again

It is now a matter of pride for the senators, whose jurisdiction over the inquiry is being questioned by Binay, to show that they have the teeth to go on with the investigation.

The jurisdictional challenge and the cold shoulder given the senators make it all the more interesting as to where this confrontation is heading.

Surely, the defiance and bad precedent created by Mayor Binay and his sycophants is an affront that the senators, knowing their powers, will counter harshly.

If the Mayor believes his father, Vice President Binay, can extricate him from the mire he has created, he better think a number of times. The subpoena is a powerful tool wielded by the members of Congress and those summoned cannot just simply ignore it, although the senators waived it out of courtesy for the Vice president.

No less than Senate President Franklin Drilon has declared that the Senate can compel individuals to appear and testify, if needed, during senate inquiries. No one, he says, is above the law.

Drilon said the Senate blue ribbon subcommittee investigating the alleged overpricing had the power to order the arrest and detention of Binay and the others if they insisted on ignoring the summons.

So we will see if Mayor Binay will honor the “show cause” order to be issued by the Senate.

I don’t think Binay really has the luxury of so many options left to take denying his presence.

But the biggest problem of all is that the investigation only glaringly underscores the ignorance and, sometimes, the incompetence of Makati’s CEO by his inadequacy in giving convincing answers in the course of the investigation by the well prepared senators grilling him.

It is about his unawareness and shallowness of knowledge compounded by his penchant for delegation of power that is making him appear inutile and irresponsible in his position as Makati’s mayor.
